AGREEMENT BETWEEN USER AND NASN - National Association of School Nurses

The NASN - National Association of School Nurses Web Site is comprised of various Web pages operated by NASN - National Association of School Nurses.

The NASN - National Association of School Nurses Web Site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. The National Association of School Nurses (NASN) honors the intellectual property rights of others.

The Code of Conduct for NASN’s online community website SchoolNurseNet sets forth ways in which community participants interact. Specific to intellectual property and copyright concerns, the norms for communities are clearly stated in the Code of Conduct.

In addition, NASN will respond expeditiously to claims of copyright infringement in the online community website if submitted to NASN's Copyright Agent as described below. Upon receipt of a notice alleging copyright infringement, NASN will take whatever action it deems appropriate within its sole discretion, including removal of the allegedly infringing materials and termination of access for repeat infringers of copyright protected content.

If you believe that your intellectual property rights have been violated by NASN or by a third party who has uploaded materials to our online community website, please provide the following information to the designated Copyright Agent listed below:

  1. A description of the copyrighted work or other intellectual property that you claim has been infringed;
  2. A description of where the material that you claim is infringing is located on the online community website;
  3. An address, telephone number, and email address where we can contact you and, if different, an email address where the alleged infringing party, if not NASN, can contact you;
  4. A statement that you have a good-faith belief that the use is not authorized by the copyright owner or other intellectual property rights owner, by its agent, or by law;
  5. A statement by you under penalty of perjury that the information in your notice is accurate and that you are the copyright or intellectual property owner or are authorized to act on the owner's behalf;
  6. Your electronic or physical signature.

NASN may request additional information before removing any allegedly infringing material. In the event NASN removes the allegedly infringing materials, NASN will immediately notify the person responsible for posting such materials that NASN removed or disabled access to the materials. NASN may also provide the responsible person with your email address so that the person may respond to your allegations.

TERMINATION/ACCESS RESTRICTION

NASN - National Association of School Nurses reserves the right, in its sole discretion, to terminate your access to the NASN - National Association of School Nurses Web Site and the related services or any portion thereof at any time, without notice. GENERAL To the maximum extent permitted by law, this agreement is governed by the laws of the District of Columbia, U.S.A. and you hereby consent to the exclusive jurisdiction and venue of courts in the District of Columbia, U.S.A. in all disputes arising out of or relating to the use of the NASN - National Association of School Nurses Web Site. Use of the NASN - National Association of School Nurses Web Site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent an d subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be drawn up in English.
